As per the Scotus Blog this is how it all started: In 2001, with the “Zadvydas v. Davis, the Supreme Court interpreted an immigration statute to require judicial review of a detention decision because “to permit[] indefinite detention of an alien would cause a serious constitutional problem.”
Wait…WHAT? An illegal immigrant somehow has constitutional rights?
The 9th Circuit thinks it’s a Constitutional problem! NO it isn’t. They are ILLEGAL aliens.
Also, the Scotus blog continued, “relying on Zadvydas v. Davis, the U.S. Court of Appeals for the 9th Circuit affirmed a district court injunction that, in the words of the appeals court, avoided “a serious constitutional problem” by requiring bond hearings every six months for immigrant detainees.”
The 9th Circuit is SHOT down by the SCOTUS! It is NOT a Constitutional problem! It’s an illegal immigration problem!
“Ultimately, the [SCOTUS] found that the 9th Circuit had misapplied the canon “because its interpretations of the three provisions at issue here are implausible.” As the court emphasized, “[s]potting a constitutional issue does not give a court the authority to rewrite a statute as it pleases.”
As reported by the Washington Examiner, “In the 5-3 decision, which Justice Elena Kagan took no part in, the Supreme Court reversed the 9th Circuit Court of Appeals decision that ruled detained immigrants must receive bond hearings every six months to determine if their continued detainment was necessary.”
