NBC’s Katy Tur is trying to say that America is a progressive nation.
Additionally, she claims the appointment of Kavanaugh should be made by the people through the President and not by confirmation of the Senate.
First, Kavanaugh definitely believes America is a Consitutional Republic. This is what Kavanaugh is all about:
He says, “I will tell each Senator that I revere the Constitution. I believe that an independent Judiciary is the crown jewel of our Constitutional Republic.”
During his speech, he then continues, “If confirmed by the Senate, I will keep an open mind in every case. And I will always strive to perserve the Constitution of the United States. And the American Rule of Law.”

Secondly, in direct contrast, we have Katy Tur, of NBC laying down that, “American’s have really moved in a much more progressive direction,” then asks her panel of guests, “Do you think it’s appropriate to take such a strict view of the Constitution given it’s 2018 and not 1776?”
The response is that although the times have changed since 1776 that the Supreme Court is separate from policy issues.
Vance, who was a student of Kavanaugh states:
‘Whether you want the laws to move in a progressive or conservative direction, the Supreme Court is a separate institution with a separate mandate under our constitutional structures.
For example, if you want abortion to be outlawed or you want abortion not to be outlawed, that is a question, and there’s an open debate around whether that question should be decided by the Supreme Court or that question should be decided by voters and state legislatures, and by federal legislators. That is a question to me about constitutional structure, not so much about policy preferences.’
Furthermore, Katy states statistics about abortion, gun control and special interest groups. Then she tries to conflate those issues into what she considers “more progressive.”
The IPSOS poll that Katy mentioned obviously forgot about Brexit and the fact that the American people DID vote President Trump in along with his list of SCOTUS picks.
